IntroductionAfter three decades of the absolute prohibition of abortion, Chile enacted Law 21,030, which decriminalizes voluntary pregnancy termination when the person is at vital risk, when the embryo or fetus suffers from a congenital or genetic lethal pathology, and in pregnancy due to rape. The law incorporates conscientious objection as a broad right at the individual and institutional levels.ObjectivesThe aim of the study was to explore the exercise of conscientious objection in public health institutions, describing and analyzing its consequences and (...) proposals to prevent it from operating as structural violence.Materials and methodsThis study uses a qualitative, post-positivist design. At the national level, according to the chain technique, people who were identified as key actors due to their direct participation in implementing the law were included. Grounded theory was used to analyze the information obtained through a semi-structured interview. The methodological rigor criteria of transferability or applicability, dependability, credibility, auditability, and theoretical-methodological adequacy were met.ResultsData from 17 physicians, 5 midwives, 6 psychologists, 8 social workers, 2 nursing technicians, and 1 lawyer are included. From an inductive process through open coding, conscientious objection as structural violence and strategies to minimize the impact of objection emerge as meta-categories. The first meta-category emerges from the barriers linked to the implementation of the law, the infringement of the rights of the pregnant person, and pseudo conscientious objection, affecting timely and effective access to pregnancy termination. The second meta-category emerges as a response from the participants, proposing strategies to prevent conscientious objection from operating as structural violence.ConclusionConscientious objection acts as structural violence by infringing the exercise of sexual and reproductive rights. The State must fulfill its role as guarantor in implementing public policies, preventing conscientious objection from becoming hegemonic and institutionalized violence. (shrink)

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. Expondremos el camino de interiorización a través del cual el hombre persigue su autognosis. Respetando la dualidad entre método y tema que caracteriza a la actividad intelectual, y la distinción entre esencia y acto de ser que caracteriza a las criaturas, ese camino hacia la autognosis se abre finalmente en busca de la réplica de que la persona humana carece. El objetivo del trabajo fue fundamentar las bases teóricas que sustentan la importancia del trabajo independiente en el proceso de enseñanza aprendizaje en la Educación Médica Superior, así como aspectos relativos a su concepción, requerimientos y formas de aplicación. Se realizó un estudio bibliográfico acerca del tema y se llegó a las siguientes conclusiones: el trabajo independiente es un medio de organizar metodológicamente la actividad cognoscitiva independiente de los estudiantes que se expresa a través de un conjunto de tareas y (...) puede utilizarse durante la actividad docente y fuera de ella, así como en cualquiera de las formas de organización de que se trate. Es imprescindible que se tengan en cuenta al organizar el trabajo independiente las etapas de la actividad humana: planificación, orientación, ejecución y control. El trabajo independiente es un factor importante para estimular la independencia de los futuros profesionales de las Ciencias Médicas por lo que su perfeccionamiento exige al profesor una alta profesionalización de sus acciones. The objective of the work was to stablish the theorical bases that sustain the importance of the independent work in the teaching learning process in the medical education, as well as, relative aspects to its conception, requirements and application forms. A bibliographical study about the topic was carried out reaching the following conclusions the independent work is a way of organizing methologically the independent cognitive activity of the students that is expressed through out a group of tasks and it can be used during the teaching - learning in and out of the classroom; as well as in any of the forms of teaching organization. It is indispensable when organizing the independent work of the students to keep in mind the different stages of the human activity planning, orientation, execution and control. The independent work is an important factor to stimulate the independent of the future professionals of the medical sciences that is why its improvement demands a higher professionalism of its actions. El objetivo del presente trabajo es poner en diálogo la filosofía poliana del límite mental con el criticismo de Kant. Mantengo que por comenzar desde el hecho de que ellos toman el mismo método como tema, ambas posiciones teóricas están interconectadas. La limitación del conocimiento, el problema de su fundamentación, y la antropología que responde a ambas cuestiones será objeto de estudio del presente artículo.

We argue that two well-known examples (strawberry distribution and Konigsberg bridges) generally considered genuine cases of distinctively _mathematical_ explanation can also be understood as cases of distinctively _generic_ explanation. The latter answer resemblance questions (e.g., why did neither person A nor B manage to cross all bridges) by appealing to ‘generic task laws’ instead of mathematical necessity (as is done in distinctively mathematical explanations). We submit that distinctively generic explanations derive their explanatory force from their role in ontological unification. Additionally, (...) we argue that distinctively generic explanations are better seen as standardly mathematical instead of distinctively mathematical. Finally, we compare and contrast our proposal with the work of Christopher Pincock on abstract explanations in science and the views of Michael Strevens on abstract causal event explanations. Gender discrimination continues to be a problem in organizations. It is therefore important that organizations use performance evaluation methods that ensure equal opportunities for men and women. This article reports the results of an experiment to investigate whether and, if so, how the gender of the rater and that of the ratee moderate the relationship between the level of subjectivity in performance appraisals and organizational attractiveness. Participants in the experiment were 313 undergraduate students. We predicted, and indeed established, that as (...) the probability increases that employee performance is evaluated by a female manager, women expect more positive outcomes of subjective, but not objective evaluation processes. Our data did not support our expectation that as the probability of being evaluated by a female manager increases, men expect less positive outcomes of subjective evaluation processes. The findings of this study contribute to our understanding of why women are over-represented in jobs with objective formula-based reward systems, such as piece-rate systems. They are also of interest to organizations that are looking for more ethical human resource management practices. (shrink)

We analyze the dynamics of repeated interaction of two players in the Prisoner's Dilemma under various levels of interdependency information and propose an instance-based learning cognitive model to explain how cooperation emerges over time. Six hypotheses are tested regarding how a player accounts for an opponent's outcomes: the selfish hypothesis suggests ignoring information about the opponent and utilizing only the player's own outcomes; the extreme fairness hypothesis weighs the player's own and the opponent's outcomes equally; the moderate fairness hypothesis weighs (...) the opponent's outcomes less than the player's own outcomes to various extents; the linear increasing hypothesis increasingly weighs the opponent's outcomes at a constant rate with repeated interactions; the hyperbolic discounting hypothesis increasingly and nonlinearly weighs the opponent's outcomes over time; and the dynamic expectations hypothesis dynamically adjusts the weight a player gives to the opponent's outcomes, according to the gap between the expected and the actual outcomes in each interaction. When players lack explicit feedback about their opponent's choices and outcomes, results are consistent with the selfish hypothesis; however, when this information is made explicit, the best predictions result from the dynamic expectations hypothesis. In this paper I probe the idea that neither possibilism nor trivialism could be ruled out on a purely logical basis. I use the apparatus of relational structures used in the semantics for modal logics to engineer some models of possibilism and trivialism and I discuss a philosophical stance about logic, truth values and the meaning of connectives underlying such analysis.

This paper takes a phenomenological perspective regarding the difficulties encountered in daily life by man in prehistory. I argue that the economics of beingnecessarily establishes man as a being that must make choices. Of these, man must eventually arrive at the realization that higher, rather than lower choices will safeguard human survival, well being and allow for prosperity. The economics of being is a form of identifying economic choice-making as a natural disposition of man’s. It is the latter condition that (...) makes man act in the world. However, even though man must act, action cannot be blind. Instead, human action is motivated and guided by man’s sense of interiority. That is, man’s existential capacity for self-reflection is also what can deliver us to autonomous rule. This form of reflective choice-making is a creative act. The paper attempts to trace this aspect of the human condition back to prehistory, in order to demonstrate that societies, institutions, invention, technology, artistic creation and economic responsibility come about as the result of human industriousness. None of the aforementioned are creations of modern man. (shrink)

The study of agriculture in ancient societies is of vital importance for the understanding of their ecological basis. This article discusses data gathered from Alonso de Molina's dictionary, published in Mexico City in 1571. Molina's information on soil, rain, plants, technology, and human labor applied to agricultural activities gives a picture of the complexity of the several native agricultural systems practiced at that time. Since the Sixteenth Century, native agriculture was impacted by the introduction of new plants, animals, agricultural equipment, (...) and techniques from the Old World. A combination of the two agricultural models conform a new Mexican model of agriculture along the Colonial times. The knowledge of Sixteenth Century agricultural systems is fundamental for the understanding of the history and the conformation of contemporary agro-ecosystems. Recent studies on ecology and social anthropology agree on the necessity to take into account historical data for the discussion of ecological sustainability. (shrink)

I argue that scientists should adopt a sexual orientation view that includes ‘internal’ sexual orientation markers such as desire, fantasies, and attraction, plus self-identification, and that these two markers should line up. By ‘internal’ markers, I mean inner states or processes of the agent. This can be contrasted with ‘external markers’, by which I mean, behaviours of the agent. I begin by critically reviewing four genetic studies of sexual orientation that are representative of the literature. I look at how each (...) of these studies deploy the concept of ‘sexual orientation’, and show a) that they are each using different notions, and b) that none of the notions are satisfactory. I argue that these accounts have a very limited amount of predictive and explanatory power. Following this, I outline what an account of sexual orientation that has more predictive and explanatory power might look like. I argue that this account will be one that includes internal markers and self-identification. (shrink)

In this paper I argue that defeasible inferences are occasion-sensitive: the inferential connections of a given claim depend on features of the circumstances surrounding the occasion of inference. More specifically, it is an occasion-sensitive matter which possible defeaters have to be considered explicitly by the premises of an inference and which possible defeaters may remain unconsidered, without making the inference enthymematic. As a result, a largely unexplored form of occasion-sensitivity arises in inferentialist theories of content that appeal to defeasible inferences.

Este artículo de investigación explora los factores relacionados con el cambio social por la educación en jóvenes en contextos de pobreza y marginación en Veracruz. Para tal efecto, recupera datos del levantamiento de información de un proyecto sobre jóvenes mediante un enfoque cualitativo realizado en ciudades medias de ese estado, en el cual se estudiaba la participación política de los jóvenes, pero el tema educativo era muy importante para comprender las trayectorias juveniles. Nuestro artículo es derivado de la investigación “Promover (...) espacios para la participación cívica, la inclusión y la reducción de la Violencia” patrocinado por el IDRC (Centro Internacional de Investigaciones para el Desarrollo de Canadá). La cual se enfocó en la inclusión social y la ciudadanía de los jóvenes en entornos de violencia, vulnerabilidad y exclusión en el estado de Veracruz. Se llevó a cabo en colaboración con la Universidad Veracruzana, el Centro de Servicios Municipales (CESEM) y el Movimiento de Apoyo a Niños Trabajadores y de la Calle (MATRACA-AC) durante al 2017 al 2020. El levantamiento del proyecto del cual recuperamos datos para este trabajo consistió en 20 grupos focales, 46 entrevistas a jóvenes y 14 a docentes en Xalapa, Coatzacoalcos, Veracruz y Poza Rica ciudades del Estado de Veracruz. Los datos indican que, al menos, existen cinco factores que constriñen los proyectos educativos juveniles: ingreso familiar, aspiraciones, contexto social, redes sociales y apoyo docente. Estos elementos de combinación contingente determinan las trayectorias juveniles individuadas en el campo escolar y pueden explicar tanto la permanencia como el abandono de la escuela en estas ciudades. In this article we propose to carry out an examination of the notions of ‘other’ based on the philosophical proposals of Maurice Merleau-Ponty and Maurice Blanchot. It seeks to show the common point between both thoughts, from a proposal in which the other is understood as a dislocation, which manifests itself in the way of an opening. For this reason, the notion of opening becomes the central element of this analysis, from which the other manifests itself in an ambiguous way. (...) To this end, the proposals of both authors will be analyzed separately, however, highlighting and relating to each other their respective conceptions of opening and the implications they have regarding the question of the other. La didáctica de las ciencias es cada vez más activa, por lo que una metodología ampliamente utilizada es el Aprendizaje Basado en Problemas (ABP). Este método implica la resolución de un problema, la que se recoge en un informe denominado Informe de resolución de problemas (IRP). Para los estudiantes esta tarea representa un gran desafío, ya que implica actuar y expresarse del modo en que lo harían los expertos en el área. Es debido a esta dificultad que se hace imprescindible (...) la orientación de los tutores a través de la retroalimentación. Existen distintos tipos y modos de retroalimentar, lo que generará un impacto en el desempeño de los estudiantes. Analizamos los comentarios evaluativos que entregan las especialistas a los estudiantes que elaboran un IRP, tanto en un borrador como en la versión final del escrito. A partir de la clasificación de comentarios escritos de Arancibia, Tapia-Ladino & Correa (2019), realizamos un análisis de los tipos y modos de comentarios evaluativos y cómo el objeto influencia el modo. Los resultados indican que, a la hora de retroalimentar, en el primer borrador las docentes centran su atención en la superficie más que en el contenido y el modo predominante es a través de órdenes. En la versión final, la retroalimentación se dirige más bien al contenido y las evaluaciones positivas y negativas aumentan. Se infiere que en la medida que los comentarios evaluativos promuevan la adecuación al género, los estudiantes se insertarán más fácilmente en la comunidad a la que han ingresado. (shrink)

El estudio del cuerpo humano mediante el apunte permite que el estudiante de Bellas Artes profundice en los complejos procesos perceptivos, cognitivos y procesuales propios del dibujo, ya que esta práctica favorece tanto el análisis del cuerpo humano, como la asimilación de estrategias para asumir la relación profunda que se establece entre el dibujante y aquello que observa, comprende y materializa en el propio dibujo. Por ello, esta ponencia es analiza los factores implicados en esta situación y ofrece diversas estrategias (...) que faciliten la adquisición de las competencias necesarias para ello tras implementar un programa de ejercicios para tal fin. Abstract Does Duns Scotus identify the natural will with the affectio commodi ? This identification has become the standard view. In this paper, I will challenge this view through an analysis of some key texts. The main thesis of the paper is that Scotus allows for two scenarios related to the will's dual affections. The first is the real situation of the created will: the will is a free potency and possesses two affections. The second is a hypothetical case; Scotus (...) suggests the fictive case of a will that only possesses the affectio commodi . Accordingly, it can be concluded that: ( i ) when considering the will in its real condition, both affections belong to the will's free appetite; ( ii ) in the hypothetical case the natural will, the intellectual appetite and the affectio commodi are all identified; ( iii ) in the real condition of the will, the natural will is a passive inclination to receive perfection. Lakatos’s approach to prediction and novel facts is of considerable interest. Prediction appears in his conception in at least three different levels: a) as an important aim of the research programs; b) as a procedure -a key method- for increasing our scientific knowledge both theoretically and empirically; and c) as the way to assess the scientific character of knowledge claims -means for evaluating results-. At all these levels he envisions a close connection between prediction and novel facts. The paper has (...) four aims. First, to examine his concept of “prediction” in Lakatos’s MSRP, taking into account different aspects. Second, to clarify the notion of “novel facts”, which requires the consideration of the various ways in which new facts can be understood. Third, to examine the prediction of novel facts as criterion of appraisal. Fourth, to explore Lakatos’s approach in connection with the field of economics, in order to shed new light on issues that have been discussed in recent years. (shrink)

SARS and monkeypox have given the public health community a unique opportunity to examine the use of quarantine measures. Until recently, the word “quarantine”was not used in polite conversation, and evoked unsavory images. The recent SARS epidemic illustrated the important role of quarantine and isolation as a public health response to communicable disease.As public health officials in Toronto began to take control of the SARS epidemic, a second wave of the disease emerged. In the first SARS epidemic, approximately 8,200 individuals (...) were isolated. There were approximately 82 probable cases, 66 suspect cases, and 24 deaths. On May 22, 2003, SARS II emerged. In total, approximately 13,000 people were quarantined. SARS II saw the onset of difficult questions being asked about the control and spread of SARS.The province of Ontario establishes the public health policies and legislative framework for the entire province. How distinct is European philosophy of science? The first step is to characterize what is or might be considered as ‘European philosophy of science’. The second is to analyse philosophy of the social sciences as a relevant case in the European contribution to philosophy of science. ‘European perspective’ requires some clarification, which can be done from two main angles: the historical approach and the thematic view. Thus, there are several structural and dynamic things to be considered in European philosophy of (...) science and compare with other conceptions: the topics discussed; the contents proposed; and the style of thought used. The case of philosophy of the social sciences is relevant for the historical approach and for the thematic view. Historically, the Erklären–Verstehen methodological controversy arose in this continent, where the main authors and most of the influential approaches are located.
